Terms & Conditions – APX Badminton Courts

By accessing, booking, entering, or using the facilities of APX Badminton Courts (henceforth referred to as APX), including via https://apxbadminton.com.au/ and its booking system, you agree to be bound by these Terms & Conditions, forming a legally binding agreement. If you do not agree, you must immediately cease use of the website, booking system, and facilities.

1. Assumption of Risk & Liability

  • Participation in badminton and use of APX facilities involves inherent risks, including the risk of personal injury or death. All entrants use the facilities at their own risk.
  • To the extent permitted by law, APX excludes all liability for injury, loss, or damage arising from use of its facilities, including negligence.
  • This does not affect any rights that cannot be excluded under Australian law.
  • Entrants agree to release and indemnify APX against any claims or expenses arising from their use of the facilities.

2. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights that cannot be excluded under the Australian Consumer Law. Where APX is liable for a breach of a non-excludable guarantee, liability is limited (at APX’s option) to the resupply of the services or the cost of having them supplied again.

3. Medical Consent

Entrants authorise APX to obtain medical assistance, treatment, and transport if reasonably required. Entrants acknowledge they may be responsible for any costs associated with such treatment or transport.

4. Behaviour & Conduct

Entrants must follow all lawful directions from APX and behave appropriately. APX may refuse entry or remove any person for misconduct, including abusive or disruptive behaviour, without refund.

5. Damage to Property

Entrants are responsible for any damage caused to APX property (e.g., flooring, nets) and must cover all repair or replacement costs.

6. Personal Property

APX is not responsible for any lost, stolen, or damaged personal belongings.

7. Entry, Security & Surveillance

  • CCTV operates on the premises at all times. By entering, you consent to being recorded. Footage may be used for security, safety, and incident investigation purposes.

8. Booking & Access

  • Courts must be booked and paid for in advance.
  • Access is via a PIN code valid from 10 minutes prior to the booking.
  • Lighting is automated and only operates during the booked time slot.
  • Entrants must vacate the court promptly at the end of their session.

9. Court Usage Rules

  • Use only the allocated court.
  • Additional time must be booked and paid for online before continuing play.
  • Members are responsible for ensuring their guests pay any relevant fees.

10. Coaching Policy

Only APX-authorised coaches may provide coaching. Unauthorised coaching or the use of professional coaching equipment (e.g., shuttle feeders) is strictly prohibited.

11. Attire Requirements

Appropriate sportswear and non-marking court shoes must be worn. APX may deny access for non-compliance to protect the court surfaces.

12. Prohibited Activities

No smoking, vaping, or alcohol. No commercial photography or recording without prior written consent.

13. Pricing

All prices are in AUD, include GST, and are subject to change.

14. User Accounts

Users must provide accurate contact details. Misuse of the booking system or providing false information may result in account suspension.

15. Court Booking Credits

Purchased credits may be used for future bookings. Bonus credits are non-refundable, non-transferable, and may have specific expiry dates.

16. Cancellations & Refunds

  • Cancellations made at least 48 hours before the booking will receive a credit or refund as per our policy.
  • Bookings cancelled less than 48 hours before the scheduled time, or unattended (“no-shows”), are non-refundable.
  • Recurring Bookings: Changes to individual sessions require 48 hours’ notice. To cancel an entire recurring series, 30 days’ written notice is required.
  • Exceptions: Requests for exceptions are assessed on a case-by-case basis only.

17. Privacy

APX collects personal information for operations and marketing. You consent to receiving service-related communications and marketing updates (opt-out available at any time).

18. Minors (Under 18)

Persons under 18 must be supervised at all times by a parent or legal guardian.

The supervising adult is responsible for the Minor’s safety, behaviour, and compliance with these Terms, and is liable for any damage caused by the Minor.

By allowing a Minor to use APX facilities, the supervising adult agrees to these Terms on the Minor’s behalf, to the extent permitted by law.

19. Parking

Entrants are responsible for parking their vehicles in designated parking spots. APX is not liable for any loss, theft, damage, or fines incurred while vehicles are on or near APX premises.

20. Fire & Emergency Safety

Entrants must comply with all fire and emergency procedures and follow any safety signage on the premises. Fire exits must remain clear at all times and must only be used in an emergency. In the event of an emergency, entrants must evacuate immediately and contact emergency services if required.

21. General

APX reserves the right to amend these Terms. Material changes will be notified via email or website announcement. Continued use of facilities constitutes acceptance of updated Terms
